ORDER I
Pending before un is the motion of intervenors Massachusetts t
Attorney _ General, Seae Anti-Pollution League, and New England I
Coalition on Nuclear D-
. tion to enjoin the Licensing Board from
" interfering" with e nding petition for review of the Board's decision in'LBP-89,
30 NRC (Nov.
9, 1989), filed by intervenors in the United States Court of Appeals for the District of Columbia Circuit.'
According to intervenors, interference may arise as a result of the Board's order of January 11, 1990, requesting that by February 1 the parties file comments and advice on what further Board proceedings are necessary under the directives in ALAB-924, 30 NRC (Nov.
7, 1989).
Intervenors assert that the Licensing Board is " acting I Massachusetts v. NRC, No. 89-1743 (D.C. Cir. filed Dec.
4, 1989).

2 beyond its jurisdiction in a belated and unlawful attempt to alter the record on review before the Court of Appeals."2 Because the Licensing' Board's January 11 order is essentially a request for-views and-comments from the parties, we.
fail to'see-how that order, in and of itself, could result in the
--e E
harm intervenors portend.
Nor are we aware of any attempt by intervenors to bring their concerns about the order to the atter. tion._ of that Board, whether through a response to the
' Board's January 11' order or.otherwise.- Thus, even assuming that it is appropriate'for us to act as intervenors request and in essenceiinterpose ourselves to-" protect" the court's jurisdiction, a matter over which-the court seemingly has plenary authority, in the circumstances we find no compelling basis for doing so.
s
.Intervenors' motion is denied.
It is so ORDERED.
