received by the Nuclear Regulatory Commission, for the export of residual 1

nuclear material,. including 41' grams of Plutonium, contained in byproduct uterial that is isonobilized in 32 borosilicate glass sealed canisters. The ultimate consignee is the GSF Institut fiir Tieflagerung for research and development purposes in the Federal Republic of Germany (FRG). The material i

is in vitrified form and will be placed in storage in the Asse Salt Mine for

. testing under an Agreement between the U.S. Department of Energy and the FRG Ministry for Research and Technology on " Methods of Treatment for Immobilization of High-level Radioactive Waste." A copy of the Agreement is attached.

Before taking action on this request, we would appreciate your views, in iaccordance with established procedures and from the overall perspective of the Executive Branch, as to whether the proposed export meets the applicable criteria in the Atomic Energy Act of 1954 as amended by the Nuclear Non-proliferation Act of 1978.
