Telephone Inspection No.89-016 This refers to the telephone inspection conducted by Mr. F. Costello of this office on December 1, 1989 of activities authorized by your State of Texas license and conducted in Marcus Hook, Pennsylvania under the general license granted by 10 CFR 150.20.
During the conversation with you, Mr. Costello determined that you did not file an NRC Form 241, " Report of Proposed Activities in Non-Agreement States",
before engaging in this activities.
10 CFR 150.20(b)(1) requires that an Agreement State licensee file a-Form 241 and 4 copies of its Agreement State specific license with the Regional Administrator of the U.S. Nuclear Regulatory Commission Regional Office for the Region in which the Agreement State that issued the license is located at least three days before engaging in licensed activities in a non-Agreement State, Contrary to the above, on October 23, 1989, Tru-Tec, Incorporated engaged in licensed activities using krypton-85 in Marcus Hook, Pennsylvania, a non-Agreement State, without filing the required Form 241.
Pursuant to the provisions of 10 CFR 2.201, Tru-Tec Incorporated is hereby required to submit to this office within thirty days of the date of this letter, a written statement or explanation in reply, including: (1) the I
corrective steps which have been taken and the results achieved; (2) corrective l
steps which will be taken to avoid further violations; and (3) the date when full compliance will be achieved. Where good cause is shown, consideration will be given to extending this response time.
