PROPOSED REGULATIONS - DEBT COLLECTION PROCEDURES N

This is in reference to your May 27, 1988 memorandum on the above subject seeking my review and concurrence on amendments-to 10 CFR Part 15.

By adopting the amendment to section 15.5 we appear to affect our ability to compromise i

claims above $20,000.. Part 15 also appears to create a collection scheme different from that provided for in section 234(c) of the Atomic Energy Act, itslegislative' history,.and10CFR2.205(h). Based on my conversation with your staff and OGC it is my understanding the propnsed rule will be modified in regard to'its application to civil penalties.
