SUBJECT:
COMMENTS OR LIKELY UTAH ACTIONS UNDER PROPOSED AMENDED AGREEMENT The LLWM staff has reviewed the proposed amended agreenent with the State of Utah at your request to assess the likely impacts of the state actions i
anticipated after the anendmer.t is approved.
As pointed out in our previous coments on the Utah proposal, Utah does not have current authority to own land used for disposal of LLW. Thus, a Utah license to dispose of source material LLW may authorize disposal on privately owned land unless the' Federal government agrees to own the site. The land ownership question. should be addressed further as a part of NRC's review of the Utah agreement proposal. We should not approve the agreement if Utah clearly plans to license commercial LLW disposal on privately owned land.
Utah may intend to use its new authority to issue a disposal license soon.
This underlines the importance of a comprehensive review of the Utah Agreement State Program.
LLWM is prepared to support the program review currently scheduled for February 1990. We should discuss how we would handle this and 1
other issues that could arise from our program review prior to conducting it.

The LLWM staff has reviewed Regicn IV's comments on the proposed amended agreement \\with the State of Utah. The LLWM staff finds Region IV's observations b
in accord with our own and, therefore, the observations have no impact on our previous.ev luation of the proposed agreement.
Further, the fact that Utah may int d to issue an early license for waste disposal pursuant to its new auttiority, reemphasizes the importance of a comprehensive review of the Utah Agreem'ont State Program.
