Dear Parties:
The purpose of this letter is to renew discussions of possible.tipulations far settlenent and withdrawal of the remaining proposed contentions in this proceeding.
Following the stipulations which have already been entered into dDong the parties and approved by the Licensing Board, there now renain pending as proposed contentions the following:
j Frun ECllP's Supplecent to Request for !! caring (docketed July 1,1980)
- 1, on equipment surveillance
- 3, on independence of the Generation Review Comittee
- 4, on (a) process for allcuing "tcnporary changes" to certain procedures and (b) process for allowing changes to procedures on Recovery Ibde inplementation and on Recovery Operations Plan implccentation
- 6, on use of real-tice monitors in the radiation ronitoring program 7
From Dr. Lochstet's August 11, 1980 filing 950 5
- 2, on steps to insure operability of neutron ronitors
- 3, on potential leakage of radioactive water fron containnent
/D As outlined in my letter of June 11, 1981 to Bill Lochstet, tio Staff believes that the basis already has been established through oiscussions for the settleracnt/ withdrawal of his remaining proposed contentions. Staff also believes that the discussions held with ECllP have provided bases for settlenent/ withdrawal of at least sore of its preposed contentions.

a 9 Additionally, during the negotiation on proposed contentions, nuterous activities have been undertaken under the Technical Specifications which are the subject of this proceeding. The proposed contentions may no longer, therefore, raise natters which ECNP and Dr. Lochstet believe need to be litigeted.
In cor. sideration of the circunstances discussed above, the Staff suggests that it would be fruitful for ECHP and Dr. Lochstet to indicate to counsel for the other parties ut9t proposed contentions can now be settled /withdra*,.n a ther on the basis of discussions held with the parties or because the passage of tino ant, intervening events have reduced their concern with the natters originall, sought to be raised.
