Report No. 70-992/81-01 This refers to the investigation conducted by Mr. J. C. Howell of this office on March 9-10, 1981, of activities authorized by NRC License No.
SNM-952 issued to David Witherspoon, Inc.
Our preliminary findings were discussed with you at the conclusion of the investigation.
The investigation was an examination of the activities conducted under your license as they relate to radiation safety and to compliance with the Commission's rules and regulations and the conditions of your license.
The investigation consisted of selective examinations of procedures and representative records, interviews with personnel, and observation by the investigator.
During the investigation, it was found that certain activities under your license appear to violate NRC requirements.
These items and references to pertinent requirements are listed in the Notice of Violation enclosed herewith as Appendix A.
As indicated in Appendix A, 10 CFR 2.201 requires that you respond in writing to the Notice; however, we have received a copy of your letter to the NRC Office of Nuclear Material Safety and Safeguards requesting that your license be terminated and a copy of your corrected Fonn NRC 742 which you submitted to the Department of Energy.
Based on these documents, a response to the Notice is not required.
