Dear Senator Nunn:

Thank you for your letter dated May 26 1981 on behalf of your constituent Mr. Steve Johnson of Richolson, Georgia.

Mr. Johnson urges that you vote against legislation to give NRC authority to grant interim operating licenses for nuclear plants without a public hearing when it comes up in Congress.

I believe Mr. Johnson is referring to proposed legislation, which was submitted by the Nuclear Regulatory Commission to Congress on March 18, 1981. The legislation wnuld allow the Comission to authorize interim reactor operation for fuel loading and low-power operating and testing before the completion of a nearing. Such interim operation would save at least two months in tne licensing process and, where the low power testing revealed a need for repairs or modifications, could save substantially more time.

I am enclosing for your information a copy of the letter from the Commission describing the proposed legislation in greater detail.

A p.~ovision similar to that croposed by the Commission has been includet ir.

the NRC FY 1982/83 authorization bill (S.1207) as reported by the Senate Cc=ittee on Environment and friToWc Work'.~ -The till-nts nct yet come to s

the Senate floor.

I hope that this information is helpful in responding to your constituent.

Sincerely.
