MOTION FOR VOLUNTARY DISMISSAL p

TO THE HONORABLE JUDGE OF SAID COURT:

Intervenor ACORN, by and through its attorney of record, l

DWIGHT H. MOQRE, Executive Director of West Texas Legal Services, moves the Atomic Safety and Licensing Board for voluntary dismissal from this proceeding, and would respectfully show the Board the i

following:

I Intervenor ACORN is a non-profit organization which operates on limited fun'ds.

II In initiating and carrying out this litigation, Intervenor ACORN was reasonably under the impression that expert witnesses and consultants who are necessary to this litigation would be made avail-able free of charge. Unfortunately, however, such expert witnesses have not been provided. The cost involved in paying the consultants and expert wi*,nesses who are necessary to continue this litigation would be massiver ACORN has limited funds and cannot afford to pay for these consultants and experts. It has therefore become necessary for Intervenor ACORN to ask this Sard for a voluntary dismissal from this proceeding.

Intervenor ACORN requests that this Motion for Voluntary DSO1

{

Dismissal be granted.
