Appendix A NOTICE OF VIOLATION The St. John and West Shore liospital License No. 34-01334-02 As a result of the inspection conducted on May 1, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violation was identified:

License Condition Nc. 15 requires that licensed material be possessed and used in accordance with statements, representations, and procedures containeu in your application dated November 20, 1978.

Item 17, of that application, requires daily surveys of preparation and injection areas and weekly surveys of all other laboratory areas.

Item 17 also requires a permauent record of the weekly survey results.

Contrary to the above requirements, daily surveys have not beca performed from the date of license issuance and records of weekly survey results were not maintained between April 15, 1979 and June 20, 1980.

This is a Severity Level V violation (Supplement VII).

Pursuant to the provisions af 10 CFR 2.201, you are required te submit to this office within twenty-five days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full com-pliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.

The method f or perf orming wipe tests wilI be sufficiently sonsitive to detect 100 cpm.

A permanent record wilI be kept of the weekly or monthly survey results, including negative resalts.

The record will include:

1.

Lucation, date, and type of equipment used.

2.

Name of person conducting the survey.

3.

Drawing of area surveyed, identifying relevant features such as active storage areas, active waste areas, etc.

Sieasured exposure rates, keyed to location on drawing (point out rates that require correct.ive action).

5.

Detected contamination levels, keyed to locations on drawing.

6.

Corrective action taken in the case of contamination or excessive expocure rates, reduced contamination levels or exposure ratn a i t.er correc t i ve actton, and any appropriate comments.

Area will be gleaned if the contamination level exceeds 100 com/100cm", except in the case of some Tc-99m spill where less radiation exposure would be received by personnel if 1he area is secured and contamination is a1 lowed to decay.
