RESPONSE OF PEOPLE OF THE STATE OF ILLINOIS TO NIPSCO'S MOTION FOR ESTABLISHMENT OF SCHEDULE On June 1, 1981 Northern Indiana Public Service Company

("NIPSCO") requested that the Board establish a schedule for com-pleting discovery and other prehearing activities and convening the hearing. The People of the State of Illinois (" State of Illinois") objects to that motion ' r the reason that it is pre-mature.

As NIPSCO noted in the motion, the NRC Staff has not yet ,com-pleted its evaluation of NIPSCO's construction permit extension re-quest, has not determined whether a new or supplemental Environmen-tal Impact Statement will be prepared, and has not adopted a posi-tion on whether good causa exists for an extension of the construc-tion permit. These factors bear significantly on what further dis-covery is needed and from whie i parties and on the subject matter and course of the hearing. Furthermore, there is discovery yet to be conducted, and a significant amount of discovery activity is curreni y in progress. Therefore, it would not be useful at this 1

time to schedule the closing of discovery and the hearing.
