Dear Mr. Stello:

PRAIRIE ISIAND NUCLEAR GENERATING PIANT Docket Nos. 50-282 and 50-306 In response to your letter of May 20, 1981, the following ia offered:

Violation 10 CFR 71.5 prohibits dell'.ery of 11 censed material to a carrier for transport unless the licensee complies with appl.f cable regulations of the Department of Transportation in 49 CFR Parts 170-189.

49 CFR 173.393(j)(2) limits the radiation level at any point on the external surface of an exclusive use, closed transport vehicle to 200 mR/hr.

Contrary to the above, on October 30, 1980, a radiation level of up to 500 mR/hr was measured on the undersurface of the transport vehicle containing Prairie Island Nuclear Generating Station waste shipment number 80-29 upon its arrival at the Richland, Washington waste disposal site.

This is a Severity Level V violation (Supplement V.E.) .

Response

1. The violation o' urred as stated.

2. Our interpretat! of contact radiation limits on the bottom of the l trailer has bee.. chat the bottom surface was defined by the place of the bottom flanges of the floor beams. We arrived at this interpre-tation because of the close spacing of the floor beams (about 6")

and the difficulty with which this space could be occupied for exposure.

Radiation levels did not exceed 200 mR/hr at the bottom of the trailer per our interpretation. While we have agreed to abide by the State of Washington's more conservative interpretation of the regulation for all future shipments, we do not believe this shipment violated the intent of 49 CFR 173.393 (j) (2).

>- 1. The violation occurred as stated.

2. . The two barrels in question are undoubtedly of an older series which had plastic labels glued on them. The labels were either not applied
f or subsequent 1y'came off the drums. Barrels, we-are receiving presently have labeling of a more permanent nature applied by the manufacturer.
3. and 4. A waste loading checklist has been developed to address this concern and others. Use of this checklist will prevent recurrence.
