Alan R. Barton Nuclear Plant, Units 1, 2, 3, and 4 was docketed on Septem P ber 27, 197.4 (39 Fed. Reg. 42708, December 6,1974). A Notice of Hearing on Application for Construction Permits for "the harton Plant was published.
on December 6,1974(39 Fed.Ry.42707).
By letter of December 5,1980 counsel for Applicant reviewed its history of having cancelled plans for the construction of Alan R. Barton Nuclear Plant, Units 1, 2, 3, and 4.
Applicant.-equested a withdrawal of its applications for construction permits for Units 3 and 4 by a filing dated December 23, 1975. On November 18, 1977 Applicant informed the Nuclear Regulatory Commis-l'

l sion that plans to construct Units 1 and 2 have been cancelled.

Applicant filed a fonnal withdrawal of its applications for construction permits for Units 3 and 4, but apparently only informally advised the NRC Staff of the cancellation of its construction plans for Units 1 and 2.
I We accept counsel's December 5,1980 letter as a request for the with-I drawal of the applications for Units 1 and 2 pursuant to 10 CFR 2.107(a).

o Staff discontinued review of the Barton Plant in 1976 and, in December 1977, Applicant surrendered its certificate of convenience and necessity for the Barton Plant to the Alabama Public Service Comission. No lim..d work authorization nor construction pemits were issued for the Barton Plant and we are infomed by counsel (letter dated February 18, 1981) that no work has been performed by Applicant at the Barton site.
The NRC Staff in its response of December 12, 1980 has no objections to the withdrawal and has not determined that any particular conditions should attach to the withdrawal.
Accordingly, pursuant to 10 CFR 2.107(a) the Board permits Applicant to withdraw without condition the construction pemit applications for the Barton Units 1, 2, 3, and 4.
This proceeding is teminated.
