Response to I&E Inspection No. 81-04 This letter is written in response to Reference (b) which indi-cates that one of our activities was not conducted in full compliance with Nuclear Regulatory requirements. This alleged item of noncom-pliance was noted as a result of an inspection of one of our shipments at the Beatty, Nevada, disposal site.

Information is submitted as follows in answer to the alleged item of noncompliance contained in the enclosure to your letter.

Item: "As a result of the inspection conducted on January 26, 27, and 29, 1981, of the shipment of radioactive waste which was shipped from your facility on January 21, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violation was identified:

10 CFR 71.5 prohibits delivery of licensed material to a carrier for transport unless the licensee complies with applicable regu-lations of the Department of Transportation in 49 CFR Parts 170-189.

" Radioactive LSA."

Contrary to the above, on January 21, 1981, the licensee delivered 153 packages of low specific activity (LSA) radioactive licensed material to a carrier for transport to the waste burial site on a tractor trailer assigned for sole use and during unloading on January 29, 1981, nine packages were not stencilled or otherwise marked

" Radioactive LSA" to identify the contents."

Response: Vermont Yankee concedes to the validity in the Notice of Violation that 9 packages were not stencilled or other-wise marked " Radioactive LSA" to identify the contents.

Each shipment has always been meticulously loaded and checked by qualified plant personnel. Although a cause for the occurrence could not be specifically determined, we have upgraded appropriate procedures to require n re-sponsible individual coordinator for each shipment, as well as establishing provisions for a more complete ship-ment loading checklist. The checklist requires the re-sponsible individual to verify by signature that all packages are labeled correctly before releasing the ship-ment.

Full compliance was achieved as of March 16, 1981.
