APPENDIX A NOTICE OF VIOLATION Nucleonic Data Systems, Inc.

License No. 04-19037-01 2811 McGaw Avenue Irvine, California 92714 As a result of the inspection conducted on March 26, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

A.

License Condition 18 requires that the licensee shall possess and use licensed material in accordance with statement, represee,ations and procedures contained in application dated May 10, 1979, :- rmed by letter dated August 23, 1979. Attachment D of the application dated May 10, 1979, requires that site surveys must be conducted at temporai, job sites where guages are used for demonstrations.

Contrary to the above requirement, a licensee's representative stated that there were no site surveys conducted prior to demonstrations at the following temporary job sites on the following dates:

This is a Severity Level V Violation. (Supplement VII) 8.

License Condition 13.A(1) requires that each sealed source containing licensed material, other than hydrogen-3, with a half-life greater than thirty days and in any form other than gas shall be tested for leakage and/or contamination at intervals not be exceed six months.

Contrary to the above requirement, at the time of the inspection, the leak test records indicated that the source assembly Serial Number 1034 containing an AMCX 735, 30 millicurie americium-241 source, and an AMCK.599, 0.1 millicurie americium-241 source, had been leak tested only on March 7, 1977, June 26, 1978 and April 27, 1979.

i Pursuant to the provisions of 10 CFR 2.201, Nucleonic Data Systems, Inc.,

is hereby required to submit to this office within twenty-five days of the date of this Notice, a written statement or explanation in reply, including:

(1) th^ corrective steps which have been taken and the results achieved; (2) corrective steps which will be taken to avoid further items of noncompli-ance; and (3) the date when full compliance will be achieved.
