Dear Mr. Chairman:

Enclosed for your information are copies of proposed rules to be published in the Federal Register by the Nuclear Regulatory Commission for public canment. The proposed amendments to 10 CFR Part 51, " Licensing and Regulatory Policy and Procedures for Environmental Protection" would preclude the reconsideration of need for power and alternative energy sources in Commission operating license reviews in the context of NEPA. As explained more fully in the enclosed notice, the Commission proposes this action because the need for power and alternative energy source issues are considered and resolved at the construction pennit stage of the licensing process. Further, it is extremely unlikely that an alleged reduction in the need for power or new developments concerning energy alternatives, in and of tnemselves, could result in the denial of an operating license.

Finally, experience has shown that constructed nuclear power plants are needed and used to produce electricity. A waiver from or exception to thesa rules, if e.dopted in final form, would be pennitted under existing Commission regulations if special circumstances are shown.

PRELIMINARY VALUE-IMPACT ANALYSIS Proposed Change - Need for Power and Alternative Energy Sources in Operating License Proceedings 10 CFR Part 51 A. NEED for the Change The NRC staff has completed a comprehensive review of the need for power and alternative energy source deteminationL that are required for the licensing of nuclear power plants pursuant to the National Environmental Policy Act of 1969 (NEPA). As a result of this review, the staff has concluded that while the need for pcwer and alternative energy sources are relevant issues at the construction permit stage for NEPA purposes, these issues need not and should not be reconsidered in operating license proceedings, in the absence of special circumstances. An alleged reduction in need for power or new developments regarding alternative energy sources, in and of themselves, would not warrant l denial of an operating license. Moreover, experience shows that con-structed nuclear power plants are needed - licensees authorized to operate such facilities do use them to produce electricity and do not abandon them in favor of some other means of generating electricity. Therefore, these proposed regulations are needed to avoid unnecessary and potentially duplicative consideration and litigation of issues previously resolved at the construction pemit stage which would not ~ l l Enclosure F

1 2 reasonably affect the operating license decision. However, an excep-tion to or waiver from the rules, if adopted, could be granted in particular cases pursuant to 10 CFR 2.758 of the Commission's regula-tions if special circumstances are shown. S. Value/ Impact on App 1tcants, Other State, Regional and Federal Authorities, the NRC and the Public. Electric utilities would be the only type of applicant to be impacted by the proposed actions. Since need for power and alternative energy source consideration are proposed to be essentially eliminated, the regulations would reduce to some extent an applicant's licensing effort. No direct value/ impact would accrue to state, regional or federal authorities unless such authorities were operating license applicants or intervenors in NRC proceedings. In the former event, the impact of the regulations would be no different than for other applicants, as described above. In the latter c/ent, the impact would be not different than for other intervenors, described below. l Reducing the scope of the operating license review may be perceived by some intervenors as adverse to their interests. However, by eliminating reconsideration of need for power and alternative energy sources issues c l l from the OL proceedings, intervenors would be able to concentrate their i resources on issues of more significance to the operating license decision. The staff believes that adoption of the proposed rule would result in a savings of time (review time and hearing time), money, and resources for the staff, and possibly the Commission, by eliminating the need to perform redundantetssessments of need for power and alternative energy sources in operating license proceedings.
