SECY-81-307 - Final Rulemaking on Appendix B to Part 2 as it Applies to Operating Licenses The Comission, by a vote of 3-1 (Comissioner Ahearne dissenting),

approved a final rule which amends its review procedure by requiring direct Comission review of Board decisions to determine whether their effectiveness should be deferred pending further agency review. Commissioner Ahearne indicated that he would attach separate views to the FRN. The final rule as modified at the meeting will te published in the Federal Register _ at the earliest practical date.

The Comission noted that in view of the short period of time available to file coments pertaining to the imediate effectiveness issue in full-power operating licenses, the Boards may need to notify parties by telephone of the issuance of a decision.

II. SECY-81-202C - Revised Draft Policy Statement on the Conduct of NRC Proceedings The Comission, by a vote of 4-0, approved the issuance of the Statement of Policy as modified at the meeting.

(Subsequently, the Policy Statement was signed by the Secretary.)

III. SECY-81-304 - Proposed Rule. ange on Adjudicatory Boards' Authority to Raise Issues Sua Sponte The Comission discussed the subject paper without reaching a decision.

2 The Comission will continue this discussion at the next meeting, together with SECY-81-310, Final Rule Amending Part 2, and SECY 311, Proposed Rule Amending Part 2.
