- THE TOLEDO EDIS0N COMPANY AND THE CLEVELAND ELECTRIC ILLUMINATING COMPANY NOTICE OF ISSUANCE OF AMENDMENT TO FACILITY OPERAllNG LICENSE The H. S. Nuclear Regulatory Commission (the Commission) has issued Amer.dment No. 40 to Facility Operating License No. NPF-3, issued to The Toledo Edison Company and The Cleveland Electric Illuminating Company (the licensees), which revised Technical Specifications (TSs) for operation of the Davis-Besse Nuclear Power Station, Unit No.1 (the facility) located in Ottawa County, Ohio.
The amendment is effective as of its date of issuance.
This amendment changes the TSs to provide consistency in tenninology between the TSs and plant design and ta ensure adequate surveillance requirements. These changes were identified during the Commission's review of Amendment No. 36 to License No. NPF-3. Amendment No. 36 allows the plant-to use a manual switchover of the Emergency Core Cooling System pumps from the Borated Water Storage Tank (BWST) to the emergency sump
~ during a loss of coolant accident after the BWST reaches ~ a low level.
The application for the amendment complies with the standards and requirements of the Atomic Energy Act of 1954, as amended (the Act), and the Commission's rules and regulations. The Connission has made appropriate M

The Commission has determined that the is:aance of this amendrent will not result in any s'gnificant envircnmental impact and.that pursuant to 10 CFR 551.5(d)(4) an environmental impact statement or negative declaration and environmental impact appraisal need not be prepared in connection wi.h the issuance 'of this amendment.
