LICENSEE'S RESPONSE TO UCS' REQUEST TO TAKE OFFICIAL NOTICE By motion dated May 20, 1981, UCS has requested the Board to take official notice of "the failure rates for diesel generators" as reported in WASH-1400.
UCS identifies the failure rates in question as those contained in Table III 4-2 of Appendix III of WASH-1400.
Licensee opposes the request.
To begin with, the data as to which UCS would have the Board take official notice are not facts or even actual failure rates.
They are instead mathematical assessments of the future probability of failure made by the authors of WASH-1400, who do not fully explain the source data on which their predictions are based.
To the extent that the source data was i
based on nuclear power plant experience, however, it would appear from Appendix III that the data included only a single year of operating reactor experience.
In any event, the data does not meet the test et indisputability or " common knowledge" necessary for official
