Appendix A NOTICE OF VIOLATION Raymond Sneider, D.O.

License No. 21-17099-01 As a result of the inspection conducted on May 12, 1981, and in accordance with the Interim Enforcement Policy, 45 FR 66754 (October 7, 1980), the following violations were identified:

1.

License Condition No. 13 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in application dated July 6, 1976.

Ites No. 11 of the above referenced application states the Capintec l

CRC-4 dose calibrator will be checked monthly for linearity.

Contrary to the above requirement, it was determined through review of records that this condition is not being met. Specifically, a linearity test was performed on November 6,1980, and February 3, 1981, to the date of this inspection. These intervals exceed the monthly requirement.

This is a Severity Level V violation (Supplement VII).

10 CFR 35.14(d)(2) requires recoros of leak test results to be kept in units of microcuries.

Contrary to the above, it was determined through a review of leak test records that this requirement is not being met. Specifically, leak test results of the cesium-137 calibration source are being l

maintained in units other than microcuries.

This is a Severity Level VI violation (Supplement VII).

License Condition No. 13 requires that licensed material be possessed and used in accordance with statements, representations, and procedures contained in application dated July 6, 1976.

Item No. 15 of the above referenced application states disposal records will be maintained to indicate a complete history of the radionuclide including its ultinate disposal.

Contrary to the above requirement, it was determined through statements i

by licensee representatives and the NRC inspectors review of records that this condition is not being met. Specifically, a licensee representative stated records are not being maintained for the disposal of byproduct material.

This is a Severity Level VI violation (Supplement VII).

Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within twenty-five days of the date of this Notice a written statement or explanation in reply, including for each item of noncompliance:

(1) corrective action taken and the results achieved; (2) corrective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation.
