SNM-1168 By letter dated April 16, 1981, Mr. D. W. Zeff, Manager,. Health-Safety and Licensing for the Nuclear Materials and Manufacturing Division of.the Babcock
& Wilcox Company (B&W) was notified his request for withholding his Emergency Plan (submitted asSection VI of thiir ren'ewal application dated February 27, 1981) did not fall within Section 2.790(d)(1) of 10 CFR Part 2...If he did not respond to the notice within 20 days,. the Emergency Plan would be placed in the Commission's Public Document Room.
Mr. Zeff was contacted by phone on May 11,1981 and asked whether he intends to respond to our notice. He' stated. that he could not supply the required justification for withholding the infonnation from public-disclosure and did not intend to respond to our notice. Therefore, the proprietary infonnation designation should be removed from the B&W " Emergency Plan."
