The Commission has reviewed S.

400, the " Regulatory Conflicts Elimination Act of 1981."

We support the objectives of the i

bill to reduce unnecessary duplication and conflict among Federal rules and regulations.

However, we recommend that the legis)ative record for S.

400 he clarified in the following respects.

O the OMB analysis and report required by section 4 of the bill is advisory, and an independent agency may disagree with any finding, conclusion, or recommendation in the report concerning that agency's rules or regulations, o

the Prasident may not make recommendations as to any duplication or conflict whj ;h concerns a rule or regulation of an independent agency without the concurrence of

Commissione: Ahearne believes the concerns underlying the Commission's; " clarifications" would be better resolved by

modifying the bill to provide that :

a an independent agency be allowed to comment on portions of the OMB analysis and report required by Section 4 l

which concern that agency's rules and regulations in l

order to provide better coordination for the resolution of overlapping conflicts and duplications; and i

the review by the Comptroller General under Section 6 include identification of any inconsistencies between recommendations of the President and independent agencies on resolution of a particular conflict or duplication between an Executive department and an independent agency.
