Thank you for your letter dated May 4,1981 infoming us of the corrective actions you have taken with respect to the matters we brought to your attention in our letter dated April 17, 1981.
NRC Regulation 10 CFR 71.5(a) incorporates into NRC regulations certain parts of 49 CFR Department of Transportation requirements.
The NRC position on the requirement for a strong, tight package is that leakage of radioactive material does not have to occur for there to be noncompliance with Paragrapn 173.392(c)('.) of 49 CFR. Put another way, leakage might not result because of particular conditions of t% shipment or merely because of good lue.k, but the package still might not meet the requirement of being strong and tight. Such situations are evaluated on a case by case basis.
