(Rejecting for Filing and Refusing to Act Upon Part of Tex Pirg's Letter of April 16, 1981) s e P
aus In a letter dated April 16, 1981, Mr. Scott, counsel for Tex Pirg, requests, inter alia, that the Board reconsider its decision set forth in the Order of April 7,1981 because "I did not file a brief because I did not feel that I could add to the information contained in the affidavit" executed by Messrs. Hunt and Hutton which was served on March 23,1981. Because Mr. Scott had failed to file a brief and thereby contravened the Board's ruling of March 16, 1981, the Board decided, in the Order of April 7,1981, that Mr. Scott was in default, 1
and that, among other things, he could not serve both as counsel and as an expert witness for Tex Pirg.
Once again Mr. Scott has ignored our Rules of Practice. Rather than filing a formal motion for reconsideration pursuant to 6 2.730, l

., he has informally submitted a letter. We will no longer tolerate such conduct, especial.ly by an attorney, and we do not accept for filing and will not act upon those portions of the letter requesting reconsideration.
In passing, we would note for Mr. Scott's edification that a) we were not and are not interested in his sub-jective feelings which purportedly prompted him not to file a brief, and that b) as defined in Black's Law Dictionary 174 (5th ed.1979),
a brief is a document setting forth a summary of the facts, pertinent laws, and an argument of how the law applies to the facts supporting
- the attorney's position.
Accordingly, this 6th day of May,1981 it is ORDERED That Tex Pirg's letter of April 16, 1981, insofar as it requests reconsideration of the Order of April 7, 1981, is not accepted for filing and will not be acted upon.
