On January 29, 1981, Intervenor Schuessler filed a Motion to Reconsider and Rescind Certain Rulings and Actions of tne Board.

The Staff filed a Response in opposition on February 19, 1981.

In his rrotion, Mr. Schuessler complains of various rulings made and actions taken by the Board during the evidentiary hearing held on January 23, 1981. These complaints were identical to cer-tain of several complaints. raised in Tex Pirg's Motion For Recon-sideration of Certain Actions Taken During Week Of Jan.18 to 24, which had been filed on January 29 and resubmitted on February 17, 1981. Our Memorandum and Order of May 4,1981, after discussing at length Tex Pirg's complaints, denied Tex Pir.g's Motion For Reconsi-goy deration. No purpose would be served by repeating herein those O

portions of that discussion which are dispositive of Mr. Schuessler's T10507037y g

. complaints, and those portions are incorporated herein by reference.

On March 24, 1981, Intervenors Cumings, Griffith, Johnston and Lemer filed a' Motion rquesting a thirty day extension of time within which to file affidavits by Dr. Bross in respcnse to affidavits previously filed, respectively, by Dr. Hamilton on March 9 and by Dr. Gotchy on March 13, 1981. Before receiving this Motion, in an Order of March 26, 1981, upon our own motion, we set a due date of April 20,1981 for the filing of Dr. Bross' affidavits. Said affidavits were filed, respectively, on March 31 and April 14, 1981.

The instant Motion has been mooted.

Accordingly, it is, this 5th day of May, 1981 ORDERED 1.

That the Schuessler Motion To Reconsider and Rescind is denied.

2.

That the Cumings, Griffith, Johnston and Lemer Motion For a Thirty Day Extension is denied.
