LBP-61-10, 13 NRC It does not appear that that decision authorizes " licensing action" within the meaning of Appendix B to 10 CFR Part 2.

For this reason, although the decision is appealable at this time under the provisions of 10 CFR 2.762, the procedures established by Appendix B do not come into play.

An appeal board is being constituted for the purpose of 1

i entertaining any appeal which may be taken from the partial initial l

decision.

Absent an appeal, that board will conduct its customary review sua sponte.
