Telecons 4/16/81 with Bill Mowry, General Atomic Co.
and Jim Gibbs, Pachrd Instruments General Atomic Company's coment of 4/9/81 on the proposed amendment suggested that GA had not interpreted the proposed limit of 10 exempt quantities in the manner that the staff had intended. GA had apparently understood "10 exempt quantities" to mean "10 sources."
To clarify this point, and to help avoid future misunderstanding if similar language is used in the effective rule, I telephoned Bill Mowry on 4/16 and read to him language in my current draft.
I indicated that the language was subject to possible further modification within NRC; however, I wished his view on whether the draft appeared to him to satisfy the intent of the GA petition.
I read the following to Mr. Mowry:
...(11) Each instrument contains no more than 10 exempt quantities.
For purposes of this paragraph (a)(9), a source or an instrument may contain either one type or different types of radio nucl ides..."
Upon discussion, I agreed with Mr. Mowry that the language would be improved by changing "...a source or an instrument..." to "...an instrument's source (s)..."
Mr. Mowry had no other proposed changes in the language.
Following my conversation with Mr. Mowry, I called Mr. Jim Gibbs of Packard Instruments (the other comenter on the proposed rule) and discussed the same language. Mr. Gibbs agreed that the intent was clear and he asked that we promptly proceed with the rulemating action and that we keep him informed of progress.
