a 7590-01 UNITED STATES NUCLEAR REGULATORY COMMISSION DOCKET N0. 50-333 POWER AUTHORITY OF THE STATE OF NEW YORK NOTICE OF ISSUANCE OF AMENDMENT TO FACILITY OPERATING LICENSE The U. S. Nuclear Regulatory Commission (the Commission) has issued Amendrent No. 52 to Operating License No. DPR-59, isse:d to the Power Authority of the State of New York, which revised the Technical Specifications for operation of the James A. FitzPatrick Nucicar Plant (the facility) located in Oswego County, New York.
The amendment is effective as of the date of its issuance.
The amendment changes the Technical Specifications to extend the maximum average fuel exposure limits for the 7x7 (types 2 and 3) fuel assemblies for exrosure values beyond those currently given in the Technical Specifications.
The application for the amendment complies with the standards and requirerents of the Atomic Energy Act of 1954, as amended (the Act), and the Co:rission's rules and regulations.
The Commission has made appropriate findings as required by the Act and the Conmission's rules and regulations in 10 CFR Chapter 1, w!,ich are set forth in the license aniendment.
Prior public notice of the amendment was not reouired since the anendment does t involve a significant hazards consideration.
r The Commission has determined that the issuance of the amendment veill not result in any significant environmental impact and that pursuant to 10 CFR ;51.5(d)(4) an environmental impact statement or negative declaration and environmental impact appraisal need not be prepared in connection with issuance of the amendment.
