"4 the intent of IE to issue a Notice of Violation and Proposed Impositi Penalties in the amount of Five Thousand Dollars to Nondestructive Inspection Service, Incorporated.
The proposed penalties were based on alleged violations relating to 1) the use of radiation survey instruments that had not been c'alibrated at the required intervals,
- 2) the use of an inoperable radiation survey instrument, 3) failure to properly train radiographers, 4) failure to barricade and post work sites, 5) failure to perform required radiation surveys, and 6) failure to maintain certain required records of surveys.
The licensee responded to the Notice in a letter dated January 27, 1981. After consideration of the licensee's response, the IE staff concluded that all but two violations did occur and no adequats reasons were given by the licensee for mitigati r or remission of the proposed penalties. One penalty was remitted.n its entirety (the item associated with records of field examinations of radiography devices) and another mitigated by one-half (the item associated with field checks of radiographic equipment). Accordingly, an Order Imposing Civil Penalties in the amount of Four Thousand Seven Hundred Dollars has been issued today. The licensee and the State of West Virginia are being informed by telephone.
Since this matter involves a remission of one item and mitigation of another item, a news release will be issued about the time the licensee is informed.
Under the terms of the Order, the licensee may, within 25 days of the date of the Order, pay the civil penalties or request a hearing.
