Dear Ms. Donelson:
In response to your letter of February 27, 1981, please be advised that the Westinghouse Electric Corporation has not filed nor asked for an exemption to filing the installation information called for in 10 CFR 70.21(g) for their proposed nuclear fuel fabrication facility near Prattville, Alabama (NRC Docket No. 70-2909). According to current regulations, this information is required to be submitted to the NRC at least nine months prior to receiving nuclear material at that facility. Since the plant is in the preconstruction stage, it is not anticipated that such information will be submitted by Westinghouse for several years.
Our staff is currently considering amending 10 CFR 70.21(g) to require that applicants file installation information only when requested to do so by the Comission. This information would be requested when the facility had been selected from the eligible facility list by the IAEA for the application of safeguards under the US/IAEA Agreement. Such modification would be consistent with the requirement on existing licensees in 10 t.FR 75.11(a).
It should also be pointed out that when this installation information is pro-vided, it will very likely contain infomation specified as proprietary under 10 CFR 2.790(d), and as such could not be released publicly.
