Dear Mr. Meyers:

On September 13, 1979, Dr. Worth Bateman, who was then Deputy

' Undersecretary of the Department of Energy (00E) testified in an NRC adjudicatory proceeding concerning an application filed by Duke Power Company for permission to store spent nuclear fuel from its Oconee facility in the spent fuel pool of its McGuire facility.

That application would involve the transshipment of 300 spent fuel assemblies between Oconee and McGuire.

Dr. Bateman testified with regard to the then-current DOE policy to provide away-from-reactor (AFR) storage capacity for use by utilities as an additional interim spent fuel storage measure until a permanent repository becomes available.

Duke Power Company's application is now before the Atomic Safety and Licensing Appeal Board, which has scheduled oral argument in this matter for

. April 22, 1981...In view of the passage of time since Dr. Bateman testified

in 1979 it is important that the attorney representing the NRC Staff at that

' oral argument be knowledgeable as to the current position of the DOE with respect to the matters regarding which Dr. Bateman testified.

To assist us in obtaining this information we would be most appreciative if you would review Dr. Bateman's testimony and provide us, in as much detail as possible, given the time constraints, DOE's present position concerning the matters discussed by Dr. Bateman and, the future of comercial reprocessing of spent fuel in the United States.

For your convenience, I am enclosing the transcript pages of the September 13, 1979 session of the hearing at which Dr. Batenan testified and during which he was cross-examined.
