JOINT STATEMENT BY THE COMMONWEALTH OF PENNSYLVANIA, THE NRC STAFF, AND LICENSEE ON EMERGENCY PLANNING REQUIREMENTS l

v The Commonwealth of Pennsylvania, the NRC Scaff and Licensee are in agreement with respect to the application of i

the following emergency planning requirements'to this proceeding:

1.

Prior to the restart of TMI-1, Licensee's emergency plans and State and local emergency response plans must comply with the requirements of 10 CFR 50.47(b) and 10 CFR 50.5 4 (g), (s), (t) and (u), and 10 CFR Part 50, Appendix E.

2.

However, Licensee is only required prior to restart to demonstrate reasonable progress toward meeting those requirements of the Commission's emergency planning regulations for which prescribed implementation dates are later than restart.

The Board's responsibilities in this proceeding are to determine whether there is reasonable assurance that such emergency plans will comply with such requirements at the time of restart.

It will be the responsibility of the Director of Nuclear Reactor Regulation, based on FEMA's findings and determinations with respect to State and local emergency plans, to determine that such requirements have been met prior to restart.

TMI-l is an operating reactor for purpose of determining compliance with the Coimission's emergency planning regulation.
