PORTER COUNTY CHAPTER INTERVENORS' MOTION FOR THE ADMISSION OF CONTENTION 14 sf I i,s n
Although the Co==ission's regulations do not explici ly provide for motions to admit contentions, the Board has indicated that it views such a motion as the appropriate way to bring a contention befere the Board.
(See, Order dated February 12, 1981.) Acccrdingly, Porter County Chapter Intervenors, by their attorneys, hereby move for the ad=ission of Contention 14, whien is being submitted si=ultaneously with this =otion.
The facts and information giving rise to Contention 14 ca e to Porter County Chapter Intervenors' knowledge at the time cf their receipt of Mr. Snie:ek's me=orandu:
dated January 10, 1981.
The submission of Contention 14-on March 6, 1981, less than two conths later'; cannot be viewed as unti=ely.
Particularly in the cire -e tances of this ' proceeding and in the absence of any possible prejudice to any other party, 'the timing of its submission is not a legiti= ate ground for the non-ad=ission of Centention 14 For these reasons, the factors set forth

Centention 14 meets all recuiremente fer c vulid contention and should be admitted in this proceeding.
It identifies the matters which Porter County Chapter Intervenors seek to have litigated and the basis for them with reasonable specificity.
Further, as we show below, it is within the proper scope of this proceeding.
In ruling on admissibility, this Board must accept the assertions of the contention, including the assertion that the issues raised in Mr. Keppler's memorandum must be heard now, as true.

Even under the restrictive view this Board has taken of Bailly, ALAB-619, Contention 14 comes within the scope of this proceeding.
In ALAB-619, as interpreted by this

Board in its Memorandum and Order (Denying Motions for

Reconsideration an'd for Certification or Referral) dated February. 20, 1981, the Appeal Board ruled that contentions wil'l-be heard if they raise-matters (1) arising from P00R ORIGINAL
reasons assigned for the extension and (2) cannet appro-priately abide the operating, license hearint.
Contention 14 meets both prongs of the test to the extent applicable, n.nd should therefore be admitted.
The contention alleges that NIPSCO cannot show the required " good cause" because of the issues raised by Mr. Keppler's memorandum, and that when the issues are considered, the latest completion date submitted by NIPSCO will be shcwn to be unreasonable.
The Board's test does not-address those matters pertaining to the reasonableness of the extension itself and thus does not appear to apply to a contention raising the reasonable-ness of the extension.
To the extent, however, that the reasonableness of the extension is inseparable from "the reasons assigned.for the extension", this prong of the Board's test is s atis fie d.
The second prong of the test, that the matters raise'd cannot abide the operating license, is clearly satisfied here.
For example, the Quality Assurance Organization and Program,and the changes which will be required by Region III before construction proceeds, deal with matters of construction and NIPSCO's ability to meet the Commission's present standards.
Similarly, the modifications required to. bring NIPSCO and the' 4
