Dear Ms. Kuhles:
This is in response to your letter of January 29, 1981 in which you requested, pursuant to the Freedom of Information Act, copies of documents pertaining to the burial of radioactive thorium on the property of Maywood Chemical.
Please find enclosed the documents listed on Appendix A.
In a February 25 telephone conversation with Ms. Sarah N. Wigginton of my staff your mother indicated that you would be willing to pay the reproduction costs. The. charge for reproducing the enclosed 556 pages is $27.80, as specified in 10 CFR 9.14(b). Please send a check made payable to the U. S. Nuclear Regulatory Comission in the amount of $27.80, along with a copy of this letter, to the Director, Division of Rules and Records, Room MNBB-4210, U. S. Nuclear Regulatory Comission, Washington, DC 20555.
In addition, several documents have been referred to other NRC offices and to the Environmental Protection Agency (EPA) for releasability determination. We will contact you as soon as the NRC reviews are completed. The EPA will respond to you directly.
Portions of documents one, two, and six of Appendix A have been deleted in order to withhold the home addresses and telepnone numbers of individuals.
Portions of document 102 have been deleted in order to withhold the names of individuals exposed to radiation. Because disclosure of this information would constitute a clearly unwarranted invasion of personal privacy, it is being withheld from public disclosure pursuant to Exemption s
(6) of the Freedom of Informatica Act (5 U.S.C. 552(b)(6)) and'10 CFR 9.5(a)(6).
The non-exempt portions are enclosed.
Purscant-to 10 CFR 9.9 of the Comission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.
The persons responsibic for this denial are the undersigned and Mr. Victor Stello, Director, Office of Inspection and Enforcement.
O This denial may be appealed to the Comission's Executive Director for Operations within 30 days from the receipt of this letter. As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U, S. Nuclear Regulatory Comission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal fr% an Initial FOIA Decision."
