UNITED STATES O

NUCLEAR REGULATORY COMMISSION n

i WASHINGTON, D. C. 20555 s,*****/

January 13, 1981 CHAIRMAN The Honorable John F. Burton United States House of Representatives Washington, D. C.

20515

Dear Congressman Burton:

In my letter of October 1,1980, forwarding information about sea disposal of radioactive waste, I indicated that we would keep you advised if further information developed.

Enclosed is a letter from Mr. Richard E.

Cunningham of our staff to Mr. George E. Earle, IV, which summarizes infomation about a possible sea disposal of radioactive material that took place in 1947. The Environmental Protection Agency has this infonna-tion for appropriate follow-up action.

A search of our records to date has not uncovered any information pertain-ing to Mr. Earle's flights nor any other classified armed service flights for the purpose of disposing radioactive materials at sea.

If you have questions about this matter, please let us know.

Sincer ly, 1
