January 26. 1981 MEMORANDUM AND ORDER Today I received the attached memorandum from Chairman Ahearne to Chief Administrative Judge B. Paul Cotter, Chairman of the Atomic Safety and Licensing Board Panel.
I reported to Chief Judge Cotter that, in my view, 10 CFR s2.780, (Ex parte communications), requires that any answer from me directly or indirectly to the Commissioners should be on the record of this proceeding.
I also advised Chief Judge Cotter that to assure completeness, any such communication should be written and served in the proceeding, orally made in a public on-the-record session or both.
I also stated that I would pref er to have any such report submitted by the entire board af ter an opportunity f or the parties to co==ent,

Therefore there will be a special session in this pro-ceeding to receive recommendations and comments on the subject matter of Chairman Ahearne's memorandum at the NRC Hearing Room, 25 Court Street, Harrisburg, Pennsylvania, beginning at 10:00 a.m.,
February 3, 1981.
ORDERED All parties are directed to attend.
There is a possibility that issues affecting all parties will be discussed and it is essential that parties be present to assert their interest and views on Chairman Ahearne's request.

TMI-l HEARIN g
Of Several Commissioners are interested in whether the TMI-l hearing can be expedited.
(As you know, the current pace is far slower than the Comissioners had originally hoped.) Therefore, please ask the Chairman of the TMI-l Board whether there are any actions the Cc. mission could take which would expedite the hearing.
These could include:
Comission deciding ocen issues.
Cc=ission clarifying policies.
Ccmmission modifying existing orders.
, Commission directing staff to take some action.
Please understand that I am not requesting any information from the Board Chairman the furnishing of which would be inconsistent with his duties as presiding officer.
