IMPOSITION OF CIVIL PENALTY - $2,000 A Notice of Violation and Notice of Proposed Civil Penalties in the amount of

$9,000 was sent to Metropolitan Edison Company (the licensee) by letter dated August 7,1980. The Notice of Violation concerned three items of apparent noncompliance associated with shipment of radioactive wastes from the inree tiile Island Unit 2 facility.

On September 8,1980, the licensee submitted to the NRC a check in the amount of $5,000 in payment of civil penalties for two items (A and C) of the Notice of Violation, but disputed the third item (B).

After consideration of the licensee's response, the proposed civil penalty of

$4,000 for Item B was mitigated by $2,000. Accordingly a Civil Penalty of Two Thousand Dollars for Item B of the Notice of Violation is imposed on the licensee.

Issuance of the Ci'vil Penalty was delayed until completion of NUREG 0760, " Investigation into Information Flow During the Accident at Three t'ile Island." This NUPEG was sent to the licensee by letter dated January 27, 1981.

Since the penalty for one of the items of noncenpliance was mitigated, an additional news release is being made by the Office of Public Affairs to clarify the matter.
