0F FACI ON PIAST DESIGN AND FME ISSCES" D'" :s 8
Q'qp l 3 On January 30, 1981, Licensee noved the Board to issue an order establishing a schedule for the filing of proposed findings of fact and conclusions of law cn plant design and procedure issues. This schedule would require the parties to file proposed findings and conclusicas on May 1,1981, and response to proposed findings and conclusions on June 1, 1981. The Cu wuaalth supports this effort r provide the Board with l
l proposed findings and conclusions as scen as possible folicdng the close t
1 of the evidentiary record, subject to the reservations stated belcw.
l The Cuuwamalth has supported and will continue to stgport procedural l
efforts to expedite this proceeding consistent with a full and fair j
adjudicatica of all issues i portant to the safe operation of IMI-1.
Accordingly, the Cu wumalth will :ake all efforts to file proposed findings and ccnclusions en plant design and procedure issues by the Fay- -
-~
1,1981 deadline proposed by the Licensee.
However, the Cuuwuaalth also requests the Board to be cognizant of thesevereconstraintsthatthisschedulewillplaceen)ennsylvania's ability to file useful proposed findings and conclusiens, and accordingly l
co be prepared to grant apprcpriate relief. First, it is not at all clear e

d at the evidentiary record will be closed en or significantly earlier than thy 1,1981.
Second, the Board is strely aware dat both the Licensee's and the Staff's cet=sel en plant design issues new have three rends in the office to prepare proposed findings and ccnclusicns while their co-cotnsel litigate trage:ent and emrgency planning issues.
SMhrly, Mr. Sholly and UCS have essentially gleted their responsibilities to be present at de hearing. Cot =sel for the Cut.wi.ealth, en tFs other hmd, intends to spend a significant arctne of tire at de hearing assisting de Board in the develug.u.it of a full and fair record en both crage ent and erergency plc ming issues. 'Ihis, in turn, recuires additicnal ti:n to prepara for cross-ey-4 atica and to coordinate de Cc:mccaalth's direct testirci.y en offsite e~ergency planning. "herefere, depending on de ultirate date en which de record is closed, it si: ply ray not be possible for the Cc; w umalth to reet the May 1, 1981 deadline.
The Cu w..aalth notes that it is not requesting relief f:txa the Cc:cissicn's nor:a1 rules of practice, which would per=it thirty (30) days after the record is closed for the filing of proposed fi. dings and cenclusicns. 10 C.F.R. 52.755(a)(2) (1980). Ee Cccrenwalth is requestinz that the Board not, in the exercise of its discretien, expedite the schedule for filing proposed findings and ccnclusicas in a ener which sculd abridge the Cu wt.aalLh's absolute right to " advise the Coccissicn" as provided for by 5274(1) of the Acc=ic Energy Act and 10 C.F.R. 52.715(c)
(1980).
'Ihe Cu.wt.aalth reiterates that it will do everything cossible to reet the preposed May 1,1981 deadline for filing proposed findings and ccnclusiens en plant design and procedure issues.
Subject to the
reservatica stated above, the Cvuumalth has no objecticus to the schedule proposed in Licensee's January 30, 1981 filing.
Respectfully subczitted,
/
