Dear Mr. Eisenhut:

By letter dated January 16, 1981, you stated your intent to hold in abeyance the request for hearing by Arkansas Power & Light Company regarding the October 24, 1980 " Order for Modification of License" concerning environ- ,

mental qualification for Arkansas Nuclear One, Units Nos. 1 and 2 until 30 days after issuance of the safety evaluations for ANO. You proposed to permit AP&L within that 30-day period to advise you whether it will pursue its request for hearing, and if so, "what issues raised by the October 24, 1980 Order and the safety evaluation [AP&L wishes] to raias."

You then sought an indication from AP&L as to whether this procedure is acceptable to it.

This will advise you that AP&L has no objection to your proposal to hold the AP&L request for hearing in abeyance

pending issuance of the safety evaluations for ANO. Based upon our interpretation of your proposal, we believe that AP&L in accepting it does not waive the right to raise any issue which could have been raised in the first instance.

Specifically, we reserve the right to request a hearing on both the specific issues raised in the forthcoming safety evaluations and the more general issues raised by the October 24 Order. 4 Sincer 1 ,
