ORDER January 19, 1981 In an unpublished September 15, 1980 order, the Licensing Board denie'. the motion of intervenor Texas Public Interest Research Group (TexPIRG) for a directive requiring the NRC staff to prepare a supplement to its Final Environmental State-ment for the Allens Creek facility.

The supplement envisioned by TexPIRG would address the environmental impacts of so-called

" Class 9 accidents".

On January 15, 1981 -- exactly four months after the entry of that order -- TexPIRG filed a motion with both.thet Licensing

.a Board and this Board in which it (1) requests the Licensing Board either to refer its ruling under 10 CFR 2.730 (f) or cer-tify the question decided in der 10 CFR 2.718 (i) ;

) and (2) asks alternatively that we direct certification (see Public Service Co. of New Hampshire (Seabrook Station, Units 1 and 2), ALAB-271, 1 NRC 4 78, 4 8 2-83 (1975)).

The motion does not endeavor to explain why TexPIRG waited so long to file it.

Nor is any good reason readily apparent.

We intend to withhold any action on the directed certifi-cation portion of the motion to abide the event of the Licensing Board's determination on the relief now sought of it.

Pending that determination, none of the other parties need file responses to the motion with us.

Should, following issuance of the deter-mination below, we conclude that responses to the request for directed certification are necessary, we will so notify those parties.

It is so ORDERED.
