Dear fir. Byars:
This letter will respond to your December 10 request for a copy of the extracts of the 27 safety-related issues identified by General Electric in the Reed Report. As was explained to you in a telephone conversation with fiark Chopko, a Commission attorney, the Commission had detemined, on October 9,1980, to make a copy of the Reed Report available to the public.
A copy of that decision and an addendum are enclosed for your information.
The General Electric Company thereafter sued the NRC to enjoin disclosure of the Report and a federal district court, in an October 31 order, barred disclosure of the Report and its contents by the NRC pending resolution of the various claims for them. Accordingly, the NRC cannot provide the infomation you seek. However, the NRC will keep you informed of the disposition of the lawsuit and may be able to respond fully to your request at a later date.
Because of the court's prohibition on disclosure, this matter does not arise under the Freedom of Information Act.
