MEMORANDUM AND ORDER January 15, 1981 (ALAB-628)
The Licensing Board authorized the Director of Nuclear Reactor Regulation to issue construction permits for the twin-unit Jamesport nuclear facility and he did so on January 4, 1979.
New York law, however, requires public utilities to obtain certi-ficates from the State's Board on Electric Generation Siting and the Environment befere starting to build.
While appeals from the 1
Licensing Board's decisions were pending, the State Siting Board announced orally in January 1980 that it would approve only a single coal-fired plant at the Jamesport site and confirmed that gSOA ruling in writing on September 8, 1980.

. Although the State Board "has yet to act definitively" en petitions to reconsider, the applicants informed us on Dece her 19, 1980 that "there is no credible possibility * *
- that it will decide to authorize nuclear units at Jamesport", and that the Lcng Island Lighting Ccmpany's " Board of Directors voted en Nove=ber 26, 1980, to end the Ja=esport nuclear project."
Representing that Jamesport will not be built irrespective of the outcome of this,
appeal, the applicants cove to terminate this preceeding as = cot, as done in analogous circumstances in Rechester Gas and Electric Corp.
(Sterling Project, Unit 1), ALAB-596, 11 NRC 367, 869 (1980).
Only the staff has answered the applicants' otion.
It advises us that the Ja=esport site needs no significant redress because the applicants never began construction, and endorses ter=inating this proceeding as they suggest.
Applicants' motion is eranted.
The appeal is dismissed and the Licensing Board decisions authori:ing construction of the Jamesport f acility ( L3P-78-17, 7 NRC 326 (1973) and LBP-73-41, 3 NRC 750 (1973))
are vacated on grounds of mcotness; the construction permit proceeding is terminated and the Director of Nuclear Reactor Regulation shall revoke the outstanding construction permits with due notice to all parties.
