Dear Mr. Denton:

Enclosed are six (6) copies of our Proprietary Report covering Environmental Qualification of Safety-Related Electrical Equipment located in a harsh environmenL. Each copy contains three (3) volumes of information. The attached affidavit sets forth the basis for our request that this information be withheld from public disclosure.

Also enclosed are six (6) copies of a non-proprietary version of the report.

AFFIDAVIT Now comes Earl A. LA:gmann, who first being duly sworn, deposes and states:

1. That he is Senior Vice President of Engineering Services and Electric Production for The Cincinnati Gas &

l Electric Company ("CG&E") and that in such position he is responsible for the design and construction of the Wm. H.

l Zimmer Nuclear Power Station.

2. That CG&E, for itself and as agent for Columbus and Southern Ohio Electric Company ("C&SOE") and The Dayton

[

l Power and Light Company ("DP&L"), the other owners of the Zimmer Station, is submitting a document consisting of three (3) volumes captioned "Wm. H. Zimmer Nuclear Power Station -

Unit 1 Environmental Qualifications" which is marked to designate it as proprietary in fulfillment of NRC requirements l regarding environmental qualification of equipment at the Zimmer Station.

! 3. That in his position as Senior Vice President he caused such report to be prepared, supervised its scope and preparation and is aware of its contents.

4. That this report and its results (hereinafter referred to as " Program"), are proprietary to the owners of the Zimmer Station.
5. That the information contained in the Environmental Qualification Report was developed on a confidential basis based upon tests and other research conducted on behalf of the owners of the Zimmer Station; at a cost of approximately

$250,000.00.

6. That information in the form contained in the report is not, to the knowledge of the Affiant, available in public sources.
7. That the owners of the Zimmer Station are currently negotiating agreements with other utilities which may lead to the payment of fees for the use of the Program or the ex-change of this information for other valuable Environmental Qualification related material.
8. That if the information contained in the document sought to be kept confidential were made available by the Nuclear Regulatory Commission to other companies, it would result in substantial economic harm to the owners of the Zimmer Station, since such information could not otherwise be obtained without an expenditure equivalent to or greater

'than that amount incurred by the owners of the Zimmer Station.

9. That he is aware of similar reports and documents which the Nuclear Regulatory Commission has maintained as proprietary pursuant to the request of the submitting party.
