by their attorneys, hereby move the Board for an Order enlarging the time by which they may file any pleadings pertaining to the Memorandum and Order of this Board dated December 24, 1980

The Memorandum and Order, dated December 24, 1980, was docketed and served on December 22, 1980. It was received in i the offices of the below-signed counsel for Porter County Chapter l Intervenors on Monday, December 29, 1980. Robert J. Vollen, ._

We believe that the Order contains misunderstandings of law, and misconceptions regarding our position. Thus, we believe that we must respond to the Order and perhaps request the Board to certif"y questions of law to the Appeal Board in light of its recent decision in Northern Indiana Public Service Company (Bailly Generating Station, Nuclear 1) ALAB-619 (November 20, 1980) or to the Commission.

Should the Order be considered as an addition or supple- -

ment to the. Board's August 7, 19'80 Order Following Special Pre-hearing Conference, our objections and request for certification

under 10 CFR 52.751a(d) would be due five days af ter service (plus five days for mailing) , or January 2, 1981. Alternatively, we may request the Board to reconsider or clarify its ruling.

'In any event, we have an insufficient amount of time to prepare such a pleading by the date it is due to be filed. The requested enlargement will not result in prejudice to any of the other

' parties to this proceeding. Therefore, Porter County Chapter

!ntervenors respectfully request that the Board enlarge the time for us to file a pleading pertaining to the December 24, 1980 Order until and including January 9,1980. .
