Dear Mrs. Lytle:
In accordance with the Department of Energy's January 23 1989 " Notice of DOE Policies and Procedures Regarding the January 1,1990 Milestone", the Nuclear Regulatory Commission (NRC) hereby verifies receipt of the enclosed certification submitted by the District of Columbia to meet Section 5(e)(1)(C)(ii) of the Low-Level Radioactive Weste Policy Amendments Act of.1985 (Act). This certification was signed by Carol B. Thompson for Mayor Marion Barry, Jr., and states in the introduction section of the submission that:
In order to achieve compliance with Section 5(e)(1)(C) of the Low-Level Radioactive Waste Policy Amendments Act of 1985,s (Mayor's) Certification as the District is submitting to the Nuclear Regulatory Commission a Governor to how LLRW in the District of Columbia will be' handled after December 31, 1992. At present the District has renewed its contract with the Rocky Mountain Compact Board for disposal of LLRW from January 1, laces 1990 through Decent >er 31, 1992.
It is our contention that this contract p the District in compliance with the 1990 milestone as required under Section 5(e)(1)(F) which allows a state to contract with a compact as long as agreement is obtained by the host state. Since the District is contracting with the Rocky Mountain Compact Board, and Nevada as the host state has agreed to this contract, the District of Columbia contends that this contract constitutes compliance with the 1990 milestone.
The document further states in the section on LLRW management disposal options that, "It is our intent to dispose of our waste after 1992 by contracting with a Compact closer to our region."
This certification was officially provided to NRC on January 2,1990. No later than January 23, 1990, copies of all certifications will be sent to Congress and to the Office of the Federal Register for publication in accordance with j e' 90o109 90Q1hh1 E
