In accordance with the Department of Energy's January 23 1989, " Notice of DOE Policies and Procedures Regarding the January 1,1990 Mil,estone," the Nuclear Regulatory Commission (NRC) hereby verifies receipt of the enclosed certifications submitted by the Central Midwest' Interstate Low-Level Radioactive Waste Compact representin the State of Illinois and the Commonwealth of Kentucky to meet Section 5(e)(1)(C (ii) of the Low-Level Radioactive Waste Policy Amendments Act of 1985 (A t). These certifications were signed by Governors l
James R. Thompson and Wallace G. Wilkinson, respectively, and certify that "The State of Illinois and the Commonwealth of Kentucky, acting cooperatively through the Central Midwest Interstate Low. Level Radioactive Waste Compact, will be capable of providing for, and will provide for, the disposal of the low-level radioactive waste generated within the State of Illinois and the CommonwealthofKentuckyasdescribedinSection(3)(a)(1)cftheLow-Level Radioactive Waste Policy Act of 1980, as amended." These certifications were officially provided to NRC on January 2, 1990. No later than January 23, 1990, copies of all certifications will be sent to Congress and to the Office of the FederalRegisterforpublicationinaccordancewithSection5(e)(1)(E)ofthe Act. At the same time, the sited states officials-named in our guidance in the February 22, 1989 Federal Register Notice will be provided with copies of all l
certifications. NRC has processed the certification in accordance with the l
summary provided to you in ry December 21, 1989, letter.
