In accordance with the Department of Energy's January 23, 1989, " Notice 1 DOE Policies and Procedures Regarding the January 1,1990 Milestone", the Nuclear Regulatory Commission (NRC) hereby verifies receipt of the enclosed certification submitted by the Stata of Delaware to meet Section 5(e)(1)(C)(11) of the Low. Level Radioactive Waste Policy Amendments Act of 1985 (Act). This cartification was signed by Governor Michael N. Castle, and certifies that the State of Delaware "is capable of providing for, and commits to providing for, f

management of all low-level radioactive waste generated within our borders i

and requiring disposal after December 31, 1992." This certification was officially provided to NRC on December 29, 1989. No later than January 23, 1990, copies of all certifications will be sent to Congress and to the Office of the Federal Register for publication in accordance with Section 5(e)(3)P.) of the Act. At the ssme time, the sited states officials named in our guioance in the February 22, 1989, Federal Register Notice will be provided with copies of cll certtfications.
