PROPOSED IMPOSITION OF CIVIL PENALTY - $3,750 This is to inform the Commission that a Notice of Violation and Proposed 1
Imposition of Civil Penalty in the amount of $3,750 will be issued on or about November 29, 1989 to Northern States Power Company. This action is j
based on the mispositioning of guards assigned as compensatory measures for degraded vital area barriers and the failure to promptly report these violations. This mispositioning resulted in-these guards being unable to maintain continuous surveillance of the areas to which they were assigned.
Although the violation was classified at Severity Level IV, a civil penalty was assessed because of the licensee's continuing poor performance in the area of compensatory measures. The mitigation and escalation factors in the Enforcement Policy were considered and the base amount of the civil penalty was mitigated by 25% due to the licensee's identification of the violations and by 50% due to the corrective actions taken after the violations were identified.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Mailing of Notice November 29, 1989 Telephone Notification of Licensee November 29, 1989 The State of Minnesota will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
