NRC STAFF RESPONSE TO APPLICANT'S MOTION FOR WITHDRAWAL OF CONSTRUCTION PERMIT APPLICATIONS On May 14, 1930, Potomac Electric Power Company requested that the Atomic Safety and Licensing Board issue an order terminatin'g the early site proceeding. The request was based upon the Company's withdrawal of its application for an early site review of the Douglas Point Nuclear Gen-erating Station. On May 27,1980 this Licensing Board dismissed the early site proceeding. Now, on December 24, 1980, the applicant has moved to withdraw its application for construction permits.

Pursuant to 10 CFR 5 2.107(a), withdrawal of the application may only be on such terms and conditions as the presiding officer may prescribe.

No site work has been performed by the Applicant to date and redress of

the site is, therefore, not required. Consequently, the Staff does not object to the granting of Applicant's motion for withdrawal of its appli-cation and, moreover, the Staff has determined that no particular conditions should attach to the withdrawal of the construction permit application.
