i NRC-03-81-95 Page 2 of 5 ARTICLE I - STATEMENT OF WORK A.
Objective The objective of this contract is to have the Contractor available to provide depositions, expert witness testimony, and technical assistance to the NRC for legal proceedings regarding the Bailly Plant. The Contractor may also be called upon for the following requirements:
1.
Provide support in preparing a brief responding to the brief filed by the Petitioners with the U. S. Court of Appeals, D. C. Circuit in connection with their suit before that Court seeking to reverse the Commission's Order of December 1979 denying a petition for a hearing on the Bailly short pile proposal.
2.
In the event that either the Court of Appeals or the Bailly Licensing Board orders a hearing on the short pile proposal, the Contractor shall be one of the principals involved in any appeal of such an order.
3.
In the event a hearing is ordered on the short pile proposal and this order is upheld upon subsequent appeal by the NRC, the Con-tractor shall be one of the principals involved in the discovery phase and shall assist the NRC in the preparation of its case, including:
(1) the preparation and answering of interrogatories; (2) the preparation of direct testimony; and (3) the cross-examina-tion of the Intervenor's witnesses.
4.
The Contractor shall be one of the individuals to be identified in the depositions starting on October 30, 1980, as a person having knowledge of the NRC review of the short pile proposal in the event that the Bailly Licensing Board admits the short pile contention into the hearing on the CP extension request by NIPSCO. As suen, he shall in turn be deposed on this matter.
B.
Work Recuirements i
Task 1 Prepare written testimony and provide expert witnessing as required to fulfill licensing objectives. This written testimony shall be submitted to the Project Officer.
A business letter report shall be submitted at the conclusion of the effort to the Project Officer with copies to the Contract Officer:
J. P. Knight, Division of Engineering; the Director, Division of Engineering, Attention:
C. Poslusny; and B. L. Grenier, Office of Nuclear Reactor Regulation. The business letter report shall contain a summary of the effort provided and the amount of funds expended for manpower and travel.

The Contractor shall plan and budget for the following meetings and travel :

A one day meeting in Bethesda, Maryland.

A one day meeting in Porter County, Indiana.
Provisions for reimbursement of travel expenses are provided in Article III of this contract entitled " Consideration".
9 ARTICLE II - PERIOD OF PERFORMANCE 4
l The period of performance with respect to this contract shall commence on i
the effective date of this contract and all effort shall be completed no later than March 31, 1981, i
ARTICLE III - CONSIDERATION i

j In full consideration of the Contractor's performance hereunder, the NRC j
shall pay the Contractor the fixed rate of $480.00 per man-day up to January 1,1981, at which time any effort performed will be reimbursed i
at the fixed rate of $520.00 per man-day. The level of effort is estimated to be three man-days. Travel to the meeting in Porter County, Indiana by private airplane is authorized at $120.00 round trip. Travel l
to the meeting in Bethesda, Maryland shall be in accordance with Federal Travel Regulations as follows:

"The Contractor shall be reimbursed for the following reasonable domestic travel costs incurred directly and specifically in the l
performance of this contract and accepted by the Contracting Officer:
1.
Actual expenses shall be reimbursed at a daily rate not to exceed
$75.00. The actual expenses amount is comprised of lodging expense plus $23.00 for meals and miscellaneous expense.
I 2.
When travel is to one of the high-rate geographical areas listed I
below, actual subsistence costs shall be reimbursed at a daily rate not to exceed the rates indicated:
Bethesda, Maryland - $75.00 i
3.
The cost of travel by privately owned automobile shall be reimbursed at the rate of 22.5c per mile.
4.
The cost of travel by rented automobile shall be reimbursed on a reasonable actual expense basis.
5.
All common carrier travel reimbursable hereunder shall be via economy class rates when available. If not available, reimburse-t j
ment vouchers will be annotated that economy class accommcJations I

Receipts are required for common carrier transportation, lodging and miscellaneous items in excess of $15.00."
ARTICLE IV - OBLIGATIONS The amount presently obligated by the NRC with respect to this contract is i
$2,000.00.
ARTICLE V - PAYMENT Payment shall be made in accordance with Clause 2 of the General Provisions entitled " Payment" as soon as practicable after completion and acceptance of all work, upon submission by the Contractor of voucher (s) in a form satisfactory to the Contracting Officer; provided, however, that said payment (s) shall not be deemed to prejudice any rights which the Government may have by law or under any other provisions of this contract.
ARTICLE VI - SDECIAL PROVISIONS VI.1 PROJECT OFFICER Performance of the work hereunder shall be subject to the technical instructions issued by the U. S. Nucicar Regulatory Commission. The technical instructions shall be signec by the Project Officer.

The Project Officer is responsibia for:
1.
monitoring the Contractor's technical progress, including the surveillance and assessment of performance and recommending to the Contracting Officer changes in requirement; 2.
interpreting the statement of work; 3.
performing technical evaluation as required; 4
performing the technical inspections and acceptances required by this contract; and 5.
assisting the Contractor in the resolution of technical problems encountered during performance.
Within the purview of this authority, the Project Officer is authorized to approve payment vouchers for supplies / services required under the contract. The Contracting Officer is responsible for directing or negotiating any changes in terms, conditions, or amounts cited in the contract.
For guidance from the Project Officer to the Contractor to be valid, j

not constitute new assignment of work or change of the expressed terms, conditions, or specifications incorporated into this contract; 3.
not constitute a basis for an extension to the period of perform-ance or contract delivery schedule; and 4
not constitute a basis for any increase in the contract price.
If the Contractor receives guidance from the Project Officer which the Contractor feels is not valid under the criteria cited above, the Contractor shall immediately notify the Project Officer.
If the Project Officer and the Contractor are not able to resolve the questions within five days, the Contractor anall notify the Contracting Officer.
VI.2 INSPECTION AND ACCEPTAtlCE Acceptance of the services and reports to be delivered herein will be made by the Project Officer.
VI.3 DISSEMINATION OF CONTRACT INFORMATION The Contractor shall not publish, per. nit to be published, or distribute for public consumption any information, oral or written, concerning the results or conclusions made pursuant to the performance of this contract without the prior written consent of the Contracting Officer. (Two a
copies of any material proposed to be published or distributed shall be submitted to the Contracting Officer.)
ARTICLE VII - GENERAL PROVISIONS This contract is subject to the Fixed Price Research and Development Contracts under $10,000.00, dated flovember 14, 1977, which incorporates the FPR Changes j
and Additions and NRC Additions, which is attache,d hereto anc made a part hereof.
Clause 14 of the General Provisions entitled " Patent Rights - Acquisition By the Government" is deleted in its entirety.
